These Terms of Use (“Terms”) govern your access to and use of the Beyston website, mobile applications, and related services (collectively, the “Services”). By accessing or using the Services, registering an account, listing products, or placing orders, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Scope and Platform Role

Beyston operates as an online marketplace that allows third-party sellers (“Sellers”) to list and sell products — including wellness, lifestyle, and parapharmacy items of European origin — to buyers (“Buyers” or “you”).

Beyston provides the platform, tools, and facilitation services but is not a party to the sales contract between Buyer and Seller. The contract of sale is formed directly between the Buyer and the Seller in accordance with the order terms accepted and dispatched.

Beyston is neither the seller nor the buyer of products (except where explicitly stated as “Sold by Beyston”). We act solely as an intermediary.

2. Eligibility and Accounts

You must be at least 18 years old (or the age of majority in your country) to use the Services. By registering, you represent that you meet this requirement and provide accurate, current information.

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized use. We may suspend or terminate accounts for violations, fraud, or legal reasons.

3. User Conduct and Prohibited Activities

You agree not to:

• List or purchase illegal, counterfeit, unsafe, or prohibited items (e.g., prescription medicines without license, hazardous substances).
• Infringe intellectual property rights, post false/misleading information, or engage in fraudulent behavior.
• Use bots, scraping, data mining, or automated access without permission.
• Harass users, post spam, or violate any laws.

We may remove content or listings that violate these Terms.

4. Ordering and Sales Process

• Product listings are invitations to treat; your order is an offer to purchase.
• The contract forms when the Seller (or Beyston, if applicable) confirms acceptance and dispatches the product.
• Prices include VAT where applicable; additional customs duties, import taxes, or shipping fees for international orders are your responsibility.
• Beyston may limit orders to reasonable household quantities.

5. Payments

Payments are processed securely via available methods on the Platform. Funds are held until delivery confirmation (escrow-like protection where implemented) or released per Seller agreement.

Beyston is not responsible for payment disputes between Buyer and Seller, except through any buyer protection program we offer.

6. Delivery and Shipping

Delivery terms, times, and carriers are set by the Seller (unless fulfilled by Beyston services). Estimated times are approximate.

Risk of loss passes to you upon delivery. For international shipments, you handle customs clearance and any extra charges.

7. Returns, Refunds, and Buyer Protection

EU Buyers: If you qualify as a consumer under EU law, you may have a statutory 14-day right of withdrawal (cooling-off period) from receipt of goods, unless exceptions apply (e.g., sealed hygiene/parapharmacy products once opened, customized items, perishables). You must notify the Seller and return goods at your cost unless Seller offers free returns.

Refunds are processed by the Seller (or via Beyston protection if available) within 14 days of return receipt.

Beyston may offer a voluntary buyer protection/guarantee (similar to A-to-Z) for eligible orders: coverage for non-delivery, damaged/defective items, or significant discrepancies — subject to claim rules and deadlines.

Statutory warranties (e.g., 2-year EU conformity guarantee) apply where Seller offers consumer sales.

8. Intellectual Property

All Platform content (logos, text, images) is owned by Beyston or licensors; limited personal-use license only. You grant Beyston a non-exclusive, royalty-free license to use, display, and promote your listings, reviews, and uploaded content.

Do not infringe third-party IP; report violations via our form.

9. Reviews and User Content

You may post reviews/comments. They must be honest and not defamatory. We may remove or moderate content.

10. Limitation of Liability

To the maximum extent permitted by law:

• Beyston provides the Services “as is” without warranties of any kind.
• We are not liable for indirect, consequential, or punitive damages, product defects, or losses from user transactions.
• Liability is limited to foreseeable direct damages from material breaches.

Nothing excludes liability for death/personal injury, fraud, or mandatory consumer protections.

11. Indemnification

You agree to indemnify Beyston against claims arising from your breach of these Terms, your content, or your transactions.

12. Termination

We may suspend/terminate access for violations. You may close your account anytime.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of [e.g., Poland / Luxembourg / relevant EU country], excluding conflict rules. Disputes shall be resolved in the courts of [relevant city/country], without prejudice to your consumer rights to sue in your country of residence (if EU consumer).

We do not participate in alternative dispute resolution unless required.
